1. Heard learned counsel for the petitioner and learned APP for the State.

2. The petitioner seeks bail in anticipation of his arrest in a case registered for the offences punishable under Sections 137(2), 96 and 3(5) of the B.N.S.

3. The learned counsel for the petitioner submits that the petitioner is a person with clean antecedent and the informant alleges that her minor daughter was kidnapped by the petitioner and Mithilesh along with 3-4 unknown accused.

4. The learned counsel for the petitioner submits that petitioner has been falsely implicated in the instant case by the informant. It is next submitted that the date of occurrence is 14.11.2024 and the FIR came to be instituted on 18.02.2025 i.e.

Patna High Court CR. MISC. No.58813 of 2025(2) dt.09-09-2025 2/2 after a delay of more than 94 days. It is also submitted that the victim has come back and her statement was recorded under Section 180 B.N.S.S. wherein she has not supported the case of the prosecution rather has stated that she went to her aunt's place without informing her mother.

5. Learned A.P.P. opposes the anticipatory bail application.

Considering the submissions made by the learned counsel for the petitioner, the petitioner, above-named, in the event of his arrest or surrender before the learned Court below within a period of six weeks, is directed to be released on bail on his furnishing bail-bonds in the sum of Rs. 10,000/- (Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of the learned ACJM-III, Jhanjharpur, Madhubani in connection with Rudrapur P. S. Case No.17 of 2025, subject to the conditions laid down under Section 438(2) of the Cr.P.C.

7. The application stands allowed.
