2. Heard learned counsel for the petitioner and learned APP for the State.

3. The petitioner seeks bail in Dumra P.S. Case No. 270 of 2024 registered for the offence punishable under Sections-413/414/34 of the Indian Penal Code.

4. As per allegation, on secret information, the informant along with other police party reached the place of occurrence. Seeing the police party, the accused persons, who were on motorcycles, started fleeing away but they were apprehended. The accused persons disclosed the name of the petitioner.

5. Learned counsel for the petitioner has submitted that the petitioner is innocent and has falsely been implicated in this case. The petitioner is a person of clean antecedenmt. Nothing has been recovered from his conscious possession. The name of petitioner has figured in the present case merely on the basis of suspicion. The similarly situated co-accused namely Rajan Kumar has already been granted bail by this court vide order dated 09-09-2024 passed in Cr. Misc. No. 61810 of 2024. The petitioner is under custody since 19.06.2024.

6. Learned Additional Public Prosecutor appearing for the State has opposed the prayer for bail.

7. Considering the above-mentioned facts and circumstances, let the petitioner above-named be released on bail on furnishing bail bonds of Rs.10,000/- with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Sitamarhi in connection with Dumra P.S. Case No. 270 of 2024, subject to the condition that the petitioner shall cooperate in the trial and make himself available as and when required by the court.
