Petitioner is in custody in connection with Katihar Rail P.S. Case No. 43 of 2019 for the offence under sections 414 of the Indian Penal Code and Section 137, 147 of Indian Railway Act.

Learned counsel for the petitioner would submit that allegation against this petitioner is that he was involved in theft of mobile. It is alleged that on search, mobile set was recovered for which petitioner did not produce any paper. Learned counsel for the petitioner submits that petitioner is in custody since 13.5.2019.

Considering the fact that no one has lodged any case of the occurrence of theft of the mobile, the Court is inclined to

No.55132 of 2019(2) dt.06-09-2019 2/2 grant bail to the petitioner, let the petitioner, named above, be enlarged on bail on furnishing bail bond of Rs. 25,000/- (Twenty Five thousand) with two sureties of the like amount each to the satisfaction of learned Court of Railway Judicial Magistrate, Katihar, in connection with Katihar Rail P.S. Case No. 43 of 2019 subject to the condition that both the bailors should be family members of the petitioner.
