The petitioner is in custody in connection with Kudhani P.S. Case No. 479 of 2021 registered under sections 341, 420, 406, 120(B), 387, 323, 506, 504, 34 of the Indian Penal Code.
As per the FIR, on the basis of written complaint of the informant Dileep Kumar Gupta, it has been alleged that accused Vijay Kumar, Chandan Kumar and Ravi Raj (the petitioner herein) took Rs. 5 lakh each from him totaling Rs. 15 lakh on the pretext of registering a land. However, the informant subsequently alleged that the petitioner and other two accused persons chose not to register the land. When he requested for the
Patna High Court CR. MISC. No.70376 of 2021(2) dt.24-05-2022 2/3 recovery the money, it has been alleged that they threatened him of dire consequences. Left with no remedy, the Kudhani P.S. Case No. 479 of 2021was lodged against them. Learned counsel for the petitioner submits that his name is Ravi Ranjan Rai and not Ravi Raj against whom allegation has been made by the informant. He further submits that there is no eye-witness to the said transaction and further submitted that the petitioner is of unsound mind. The learned APP has brought this Court's attention to Annexure-2, the alleged transaction of Rs. 5 lakh on 1000/- Non-Judicial Stamp in which the petitioner has confirmed taking of Rs. 5 lakh from the complainant/informant herein.
He further submits that the allegation in the FIR against the petitioner is clear that he chose to dupe the informant of Rs. 5 lakh inasmuch as after receiving the amount he not only chose not to get the land registered he even threatened him of dire consequences when the informant requested to return the money. He lastly submits that a bare perusal of pare-3 of the bail application shows that the petitioner has criminal antecedent.
