The present modification petition is being filed as to modify the condition of Cr. Misc. No. 68203/2022 dated 26.04.2023, wherein it was directed to the petitioner to surrender before the learned trial court within four weeks thereafter.

It is pointed out by learned counsel that due to death of father of the petitioner as he was engaged in post death rituals, could not surrender within four weeks as directed above. Accordingly, as the petitioner could not surrender out of natural compulsion, which was not intentional, the date of surrender be extended for two weeks as of now.

Considering the submission and reason as stated

Patna High Court CR. MISC. No.64830 of 2023(3) dt.06-10-2023 2/2 above, the petitioner is directed to surrender within next two weeks from today before the learned trial court in terms of the direction passed in Cr. Misc. No. 68203/2022 dated 26.04.2023. This order shall be treated as part of order dated 26.04.2023.

This application is allowed.
