The petitioner seeks regular bail in connection with Mansi P.S. Case No. 215 of 2021 (GR. No. 2378 of 2021), registered for the offence punishable under Sections 25(1-b)a, 26 of the Arms Act.

The allegation is regarding the informant along with other police personnel having apprehended the petitioner and upon search, one loaded country made pistol was recovered.

The learned counsel for the petitioner has submitted that the petitioner is innocent and he

The learned counsel for the petitioner has further submitted that though the petitioner is an accused in one other case, but he is on bail in the said case. The petitioner is stated to be languishing in custody since 27.7.2021. The learned counsel for the petitioner has further submitted that the petitioner has already suffered sufficiently on account of the period of custody already undergone.

Per contra, the learned APP for the State has vehemently opposed the prayer for bail.

Having regard to the facts and circumstances of the case, considering the submissions made by the learned counsel for the petitioner and taking into account the materials available on record as also considering the period of incarceration of the petitioner herein, I deem it fit and proper to direct for release of the petitioner on regular bail.

Accordingly, the above named petitioner is directed to be enlarged on bail on furnishing bail

Patna High Court CR. MISC. No.70244 of 2021(2) dt.09-06-2022 3/3 bonds of Rs. 10,000/- (rupees ten thousand) with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Khagarai in connection with Mansi P.S. Case No. 215 of 2021.
