2. The petitioner apprehends his arrest in a case registered for the offence punishable under Sections 147, 148, 149, 341, 323, 307, 302, 447, 504 and 506 of the Indian Penal Code.

3. As per prosecution case, it is alleged that all 7 F.I.R. named accused persons, including this petitioner, along with two unknown persons, abused and assaulted husband of informant. It is further alleged that when son of informant came to save him, he was also assaulted due to which, during course of treatment, son of informant died.

4. It is submitted by learned counsel appearing on behalf of the petitioner that petitioner is quite innocent and has

Patna High Court CR. MISC. No.60804 of 2025(2) dt.28-11-2025 2/2 committed no offence. Allegation of assault is general and omnibus and no specific accusation of overt act has been alleged against this petitioner. Petitioner claims clean antecedents.

On the other hand, learned A.P.P. for the State has vehemently opposed the prayer for grant of anticipatory bail to the petitioner and submitted that petitioner is named in the F.I.R. with specific accusation that he, along with other F.I.R. named accused persons and two unknown persons, assaulted husband and son of informant due to which, during course of treatment, son of informant died.

6. Considering the facts and circumstances of the case, fact that petitioner is one of the assailant of the deceased and gravity of offence, the prayer for grant of anticipatory bail to the petitioner is rejected.
