This application, for grant of anticipatory bail, arises out of Runnisaidpur Police Station Case No. 94 of 2019, disclosing offences under Sections 341/323/353/504/506/34 of the Indian Penal Code.

The allegation against the petitioner, as per the First Information Report lodged by the Assistant, posted in Gangwara Bujurg Panchayat, Runnisaidpur block, is that on the date of occurrence, when the informant was engaged in his work for preparing the list of beneficiaries under the Pradhan Mantri Awas Yojana, for Ward No. 12, the petitioner along with his son demanded the list from the informant and when the informant refused, the informant was assaulted by the accused persons by

Learned Counsel for the petitioner submits that the petitioner has got no criminal antecedent and has not committed any offence in the manner alleged. He submits that the name of the petitioner was already there in the list of beneficiaries under the Pradhan Mantri Awas Yojana and the petitioner had requested the informant to send the list to the Block Development Officer for payment of the amount under the scheme for construction of his house because the petitioner does not have any house in his name, the informant demanded illegal amount from the petitioner, for which a complaint case has been lodged by the wife of the petitioner, having Complaint Case No. 433 of 2019.

After having heard learned Counsel for the parties and taking into consideration the fact that the name of the petitioner was already in the list of beneficiaries under the Pradhan Mantri Awas Yojana, as stated by the petitioner, I am inclined to grant the petitioner privilege of anticipatory bail. Accordingly, this application is allowed.

Let the petitioner, Md. Dabbir Alam @ Dabir Alam @ Dabbir Aalam, in the event of his arrest or surrender before the
