The petitioner seeks regular bail in connection with Aurangabad Mufassil Police Station Case No. 206 of 2021, registered for the offences punishable under Sections 147/149/ 448/341/323/324/307/379/504 of the Indian Penal Code. The prosecution case, as per the First Information Report, is that the petitioner, along with other co-accused persons, assaulted the informant by means of lathi, danda etc. Learned Counsel for the petitioner submits that both the parties are co-villagers and there is case and counter case between the parties inasmuch as co-accused Naulakh Yadav has lodged Aurangabad Mufassil Police Station Case No. 210 of 2021 against the informant and others for the incident
Patna High Court CR. MISC. No.70317 of 2021(2) dt.24-05-2022 2/2 which has taken place on the same date and time. He further submits that from perusal of the injury report (Annexure 3), it would be evident that the injuries sustained by the informant are simple in nature. He further submits that the petitioner is in custody since 01.11.2021.
Regards being had to the submissions made on behalf of the parties and taking into consideration the materials on record and the fact that both the parties are co-villagers, there is case and counter case between them, injury caused to the informant is simple in nature and the petitioner is in custody since 01.11.2021, I am inclined to grant regular bail to the petitioner.
This application is, accordingly, allowed.
Let the petitioner, above named, be released on bail, upon furnishing bail bond of Rs. 20,000/- (twenty thousand) with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Aurangabad, in connection with Aurangabad Mufassil Police Station Case No. 206 of 2021.
