JUSTICE SHIVAJI PANDEY ORAL ORDER 15-06-2015 Heard learned counsel for the petitioner and the State. In this case, petitioner is seeking bail in Bhagwanpur P.S.Case No. 18 of 2015 registered u/s 363, 366(A)/34 IPC. As per the FIR, on 8th February 2015 the victim girl was taken away and she herself fled away from the confinement and after recovery she made her statement on 10th February 2015 i.e. after two days. She stated that she was handed over to another person and later on she somehow escaped from their clutches. Though the petitioner is named in the FIR but the victim in her statement u/s 164 Cr.P.C. has not taken her name. In the facts and circumstances of the case, petitioner Binod Rajak is directed to be released on bail on his furnishing bail bond of Rs.10,000/- (ten thousand) with two sureties of the
Patna High Court Cr.Misc. No.16696 of 2015 (2) dt.15-06-2015 2/2 like amount each to the satisfaction of Chief Judicial Magistrate, Begusarai in connection with Bhagwanpur P.S.Case No. 18 of 2015, subject to the conditions that:
(i) one of the bailors will be a close relative of the petitioner, (ii) if the petitioner would be found involved in similar type of case in future, prosecution will be at liberty to file application for cancellation of bail and the court below will pass necessary order, including cancellation of bail bonds and (iii) that the petitioner would co-operate and if the petitioner will fail to co-operate in the proceeding of the court and will remain absent for two consecutive dates without reasonable explanation, the court will pass appropriate order, including cancellation of bail bonds.
