The petitioner is apprehending his arrest in a case registered for the offences punishable under Sections 420, 406, 120B, 467, 468, 471 of the Indian Penal Code.
The prosecution case as per F.I.R lodged by the in-charge, Headmaster of the school is that an amount of Rs. 15,28,437/- was given to the Supervisor viz. Anmol Kumar for construction of a new school building and toilet but the work up to the value of only Rs. 11,87,367/- was found to have been done. It has

It is submitted by learned counsel for the petitioner that petitioner has falsely been implicated in this case because he is the brother-in-law of co-accused Anmol Kumar who was the Technical Supervisor. It has further been submitted that according to the measurement book, the entire work has been completed. For some part of the work which had remained unfinished, an attempt was made by the accused pesons and ultimately even that unfinished work has now been completed. Moreover, co-accused Anmol Kumar has already been granted anticipatory bail by a coordinate bench of this Court vide order dated 06.08.2021 passed in Cr. Misc. No. 5000 of 2021.
In the facts and circumstance of the case, let the petitioner, above named, in the event of his arrest or surrender before the Court below within a period of four weeks from today, be released on anticipatory bail on

No.70948 of 2021(3) dt.19-09-2022 3/3 furnishing bail bonds of Rs. 10,000/-(Ten Thousands) with two sureties of the like amount each to the satisfaction of learned Judicial Magistrate, 1st, Class, Madhepura in connection with Shankarpur P.S. Case No. 05 of 2016, subject to the conditions as laid down under Section 438(2) of the Cr.P.C.
