JUSTICE MUNGESHWAR SAHOO ORAL ORDER 21-01-2015 Heard the learned senior counsel, Mr. Ramakant Sharma, for the petitioner, Suraj Kumar @ Monu, who apprehends his arrest in Fatuha P.S. Case No.326 of 2011 registered for the offences punishable under Section 366A / 120B of the Indian Penal Code. Heard the learned A.P.P. also.

The learned senior counsel for the petitioner submitted that the complaint case was filed by the father of the girl wherein specifically, it is stated that his girl was recovered from the house of accused No.2, Chandan Kumar. However, against the petitioner, it is alleged that the petitioner being the gotia tried to tarnish the image of the complainant in the society, therefore, he conspired and kidnapped the daughter of the complainant. No.31518 of 2014 (2) dt.21-01-2015 2 / 2 learned counsel further submitted that earlier also, the complainant filed another case against this present petitioner alleging that the petitioner had kidnapped his daughter for the purpose of marrying her. The petitioner has been granted regular bail by this Court on 16.07.2012 in Cr. Misc. No.24998 of 2012.

Perused the complaint case. The allegation against the petitioner is only conspiracy. According to the complainant, the daughter was recovered from the house of Chandan. Considering the above facts and circumstances of the case and the nature of allegation against the petitioner, I direct the petitioner, in the event of his arrest / surrender within one month from today to the Court concerned, shall be released on bail on furnishing bail bonds of Rs.10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of the A.C.J.M., Patna City in connection with Fatuha P.S. case No.326 of 2011 subject to condition as laid down under Section 438 (2) of the Cr.P.C.
