2. The petitioner seeks regular bail in connection with Purnahya P.S. Case No. 111/2023, lodged on 22.08.2023, under Sections 394/412/307 of the Indian Penal Code.

3. As per the prosecution, F.I.R. has been lodged against unknown accused persons including the present petitioner with an allegation that they have assaulted and stabbed knife in the abdomen of the informant's brother and took away his motorcycle along with mobile and cash.

4. Learned counsel for the petitioner submits that the petitioner is innocent and has committed no offence.

No.63690 of 2024(2) dt.04-09-2024 2/3 Counsel also submits that the name of the petitioner has been figured in this case only by virtue of confessional statement of the co-accused. He also submits that no cogent material has come against the petitioner. Counsel further submits that the criminal antecedent of the petitioner is not clean and there are three cases pending against him in which he is on bail. The petitioner is in custody since 04.09.2023. He further submits that one of the co-accused has been granted bail vide order dated 18.04.2024 passed in Cr. Misc. No. 13148 of 2024.

5. Learned APP for the State opposes the prayer for bail.

6. In the present facts and circumstances of this case and the submissions made above, let the petitioner above named be granted bail after framing of charge, if the charge is not framed yet as well as on being satisfied by the Trial Court that petitioner is not absconding in any of the cases mentioned below and on furnishing bail bonds of Rs. 30,000/- (Rupees Thirty thousand) with two sureties of the like amount each to the satisfaction of Learned Sessions Judge, Sheohar in connection with Purnahiya P.S.
