JUSTICE VINOD KUMAR SINHA ORAL ORDER 04-09-2019 This application, for grant of anticipatory bail, arises out of Abadpur No. 79 of 2019, disclosing offences under Sections 341, 323, 325, 307, 379, 504, 504/34 of the Indian Penal Code.

Prosecution case is that the informant came to know that her husband Md. Meraj is going to solemnize second marriage and when she went to protest, it is alleged that her husband Md. Meraj caught hold of her and this petitioner inflicted knife blow causing injury to her in temporal region. Submission of learned counsel for the petitioner is that petitioner has falsely been made accused in this case and the real fact is that in the scuffle informant fell down and received injury by some sharp substance.

Learned counsel for the State opposed the prayer for

Patna High Court CR. MISC. No.55657 of 2019(2) dt.04-09-2019 2/2 bail.

Having heard both sides, considering the facts and circumstances of the case, I am not inclined to grant the privilege of anticipatory bail to the petitioner rather petitioner should surrender before the court below and make prayer for regular bail and if any such application is filed, the court below will dispose of the same on the merit of the case, without being prejudiced by this order.

This application is, accordingly, dismissed.
