2. The petitioner apprehends his arrest in a case registered for the offence punishable under Sections 331(4) and 305 of the B.N.S..
3. As per prosecution case, on 10.07.2024 at night, some unknown persons committed theft of parts of Hyva truck of informant. During search, the stolen parts were found being sold in the shop of this petitioner.
4. It is submitted by learned counsel appearing on
Patna High Court CR. MISC. No.62323 of 2025(2) dt.10-09-2025 2/3 behalf of the petitioner that petitioner is quite innocent and has committed no offence. As a matter of fact, petitioner has falsely been implicated in this case merely because he happens to be owner of the Kabari shop and no incriminating article has been recovered from conscious possession of this petitioner. Petitioner was unaware that those parts were stolen which were sold to his shop. Petitioner claims clean antecedents.
5. Learned A.P.P. for the State has vehemently opposed the prayer for grant of anticipatory bail to the petitioner.
6. Considering the facts and circumstances of the case, nature of accusation and clean antecedents of the petitioner, the prayer for grant of anticipatory bail to the petitioner is allowed.
7. Accordingly, in the event of arrest/surrender within a period of eight weeks from today, let the above named petitioner be enlarged on bail on furnishing bail-bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned C.J.M., Gaya in connection with Kotwali P.S. Case No. 370 of 2024, subject to condition as
