JUSTICE ANIL KUMAR UPADHYAY ORAL ORDER 04-12-2019 Heard learned counsel appearing on behalf of the petitioners and learned counsel appearing on behalf of the State. The grievance of the petitioner in the present case is inaction on the part of the respondents in the matter of removal of encroachment over public land.

Learned counsel appearing on behalf of the petitioner submits that there is public petition for removal of encroachment but no action was taken on such petition. Considering the aforesaid, the writ petition is disposed of with liberty to the petitioner to approach the Circle Officer, Chhaurahi, Begusarai alongwith a copy of this order and the Circle Officer is under obligation to take steps for removal of

Patna High Court CWJC No.175 of 2019(2) dt.04-12-2019 2/2 encroachment at the earliest in accordance with the provisions of the Bihar Public Land Encroachment Act after providing opportunity of hearing to the persons likely to be adversely affected.
