The petitioner has preferred this application for grant of regular bail in a case registered under section 30(a) of the Bihar Prohibition and Excise Act, 2016.

As per the prosecution case, 103.68 litres of liquor was recovered from the two motorcycles of which the petitioner happens to be the registered owner of one.

It is submitted by learned counsel for the petitioner that the petitioner has been falsely implicated in the case because one of the motorcycle was registered in the name of this petitioner. No incriminating article has been recovered from his possession. He is in custody since 12.9.2021 and has no criminal antecedent. Chargesheet has been submitted in the case.

Having heard learned counsel for the parties and taking into consideration the petitioner not having been arrested at the spot together with the petitioner not having any criminal antecedent and having remained in custody for over 8 months, the Court directs the petitioner to be enlarged on bail in connection with Barauli P.S. Case no. 263 of 2019 on furnishing bail bond of Rs.10,000/ (Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of the learned Additional District & Sessions JudgeII-cum-Special Judge, Excise, Gopalganj.
