====================================================== CORAM: HONOURABLE MR. JUSTICE RAJENDRA KUMAR MISHRA ORAL ORDER 09-05-2019 Heard learned counsel for the petitioners and the learned A.P.P. for the State.

The petitioners apprehend their arrest in connection with Keoti P.S. Case No.140 of 2018 registered under Sections

Patna High Court CR. MISC. No.9661 of 2019(3) dt.09-05-2019 2/3 147, 148, 149, 341, 323, 324, 307, 427, 379, 504 and 506 of the Indian Penal Code.

The accusation is that while Rahul Kumar Manjhi, the son of the informant, was going to drop his brother and two more children to the school on the motorcycle, then, in the way, Ramkrit Manjhi (petitioner no.9), Mithilesh Manjhi, Vishnu Manjhi and Renu Devi (petitioner no.1) stopped the motorcycle of the son of the informant and made objection for moving on the motorcycle on the path, then son of the informant made protest. Thereafter, Chaturanjan Das (petitioner no.2), Sunita Devi (petitioner no.3), Mukesh Manjhi (petitioner no.4), Pradeep Manjhi alias Kari (petitioner no.5), Umesh Manjhi (petitioner no.6), Pawan Devi (petitioner no.7) and Jiwachh Manjhi (petitioner no.8) came and, thereafter, on the order of Mithilesh Manjhi, all started to cause assault to the son of the informant through fists and slaps.

Thereafter, Mithilesh Manjhi caused assault to the informant at his head through farsa. At that time, Vishnu Manjhi caused assault to the informant at his head through iron rod and other also caused assault to the informant through lathi and danda. When Bajrangi Manjhi, the brother of the informant, rushed there, Ramkrit, Kari, Jiwachh and Umesh also caused assault to him through lathi.

Patna High Court CR. MISC. No.9661 of 2019(3) dt.09-05-2019 3/3 the wife of the informant was also assaulted by Sunita, Renu and Pawan Devi.

Learned counsel appearing on behalf of the petitioners submits that there is general and omnibus allegation against the petitioners to cause assault to the informant, his son and others. Further submission is that the petitioners have antecedents. Having considered the facts and the circumstances of the case, let the petitioners, above named, in the event of their arrest or surrender by them within six weeks from today, be enlarged on bail on their furnishing bail bond of Rs.10,000/- (Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of the 1st Additional Sessions Judge, Darbhanga, in connection with Keoti P.S. Case No.140 of 2018, subject to the conditions laid down under Section 438(2) Cr.P.C. (Rajendra Kumar Mishra, J) P.S./- U T
