The petitioners are apprehending their arrest in a case registered for the offences punishable under Sections 341,323,307,506/34 the Indian Penal Code.

Specific allegation is against two person to have caused injury at the head of the informant. Those person are coaccused-Laldeo Bhuiya and petitioner- Rajdeo Bhuiya. They allegedly assaulted with Tangi and iron rod. The Doctor has found single injury, at the head of the informant caused by hard and blunt substance, simple in nature.

Submission is that in the aforesaid circumstance, it

Patna High Court Cr.Misc. No.3390 of 2019(2) dt.24-01-2019 2/2 is difficult to attribute as to which of the two person had caused the single injury. Further submission is that there is no specific allegation against other petitioners and none of the petitioners have got any criminal antecedent.

Considering the aforesaid material, let the petitioners, above named, in the event of their arrest or surrender before the court below within a period of thirty days from the date of receipt of the order, be released on bail on furnishing bail bond of Rs.20,000 (Twenty Thousand) each with two sureties of the like amount each to the satisfaction of learned court below where the case is pending in connection with Madanpur P.S.Case No. 252 of 2018, subject to the conditions as laid down under Section 438(2) of the Code of Criminal Procedure and further the petitioners shall fully cooperate with the investigation/trial of the case, failing which the court below shall be at liberty to cancel the bail bond of the petitioners.
