The petitioner, being the husband of the complainant is apprehending arrest in a complaint case wherein process has been directed to be issued after cognizance being taken for the offence punishable under Section 498A of the IPC. The prosecution case as per the complaint petition is to the effect that marriage of the complainant with the petitioner was performed in February, 2015, but subsequently, for nonfulfillment of further dowry demand of a she-buffalo, the complainant was tortured and ultimately she was driven out from the matrimonial house.

It is submitted by learned counsel for the petitioner that the

No.2215 of 2019(2) dt.17-01-2019 2/2 complainant died at her parents' house and thereafter the dead body of the complainant was brought to her matrimonial house, where last ritual was performed. It is further submitted that other accused persons have been granted privilege of anticipatory bail by the learned Court below itself, since it was submitted that now the parents of the complainant are not appearing.

Learned APP submits that accusation against the petitioner is specific.

Considering the nature of accusation, let the above named petitioner be released on anticipatory bail in the event of arrest/surrender before the learned Court below within a period of twelve weeks from today, on furnishing bail bonds of Rs. 10,000/- (ten thousand) with two sureties of like amount each to the satisfaction of learned ACJM, Benipatti, Madhubani in connection with C.R. Case No. 193 of 2016, corresponding to T.R. No. 1986 of 2017, subject to the condition as laid down under Section 438(2) of the Cr. P.C.
