Petitioner apprehends arrest in connection with Barun P.S. Case No. 329 of 2022 registered for the offence under sections 379/411 of the Indian Penal Code, section 04(1A) of Mines and Minerals (Develo0pment and Regulation) Act, 1957 & Section 11, 18, 41 and 56 of the Bihar Minerals (Concession, Prevention of Illegal Mining, Transportation and Storage) Rules, 1972 and Section 56 of Newly Amended Act, 2021.

Learned counsel for the petitioner submits that petitioner is not the owner of the truck, tractor and the places

Patna High Court CR. MISC. No.60027 of 2022(2) dt.03-01-2023 2/2 whereupon the sand was stored. The alleged place belongs to one Parikha Yadav. Petitioner has been falsely implicated in this case at the instance of local influential persons. Considering the facts and circumstances of the case and the submissions advanced on behalf of the parties, the petitioner, above named, is directed to be released on bail on furnishing bail bonds of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of Chief Judicial Magistrate, Aurangabad in connection with Barun P.S.
