In this application for anticipatory bail the petitioners apprehend their arrest in a case punishable for the offence under section 315 of the I.P.C.

Allegedly the petitioners pushed the wife of the informant from behind and fled away resulting water and blood started oozing from her private part then she was brought to Danapur Sub-divisional Hospital where she was advised to go to P.M.C.H. on account of seriousness but due to lack of time she was admitted in Sana Maternity Centre and in course of treatment the doctor informed about her miscarriage as she was having pregnancy.

Patna High Court Cr.Misc. No.30472 of 2014 (2) dt.21-01-2015 2/2 Submission is of false implication and further that F.I.R. was instituted after inordinate delay of more than five days without any explanation. Husband of both the petitioners had also been falsely implicated by father-in-law of the informant in Maner P.S. Case No. 441 of 2013 and to harass the entire family this case has been lodged. The Doctor who examined in Sana Maternity Centre had found the water discharge since 4-5 days and as such on this ground alone the petitioners who are ladies deserve sympathetic consideration.

Considering that the petitioners are ladies and there is enmity between the parties and as such the petitioners in case of their arrest or surrender within two months from the date of receipt/production of a copy of this order shall be released on bail on furnishing bail bonds of Rs. 10,000/- (Ten thousand) each with two sureties of the like amount each to the satisfaction of A.C.J.M. Danapur, Patna in Maner P.S. Case No. 465 of 2013, subject to the conditions as laid down in section 438 (2) Cr.P.C. (Jitendra Mohan Sharma, J) Abhay/- U T
