2. The petitioner seeks regular bail in connection with N.D.P.S. (Spl) Case No.01 of 2023, arising out of Bhimpur P.S. Case No. 12 of 2023, lodged on 22.01.2023, for the offences punishable under Sections 08/20B(ii)(c)/22(c)/27 of the Narcotic Drgus & Psychotropic Substance Act, 1985.

3. Learned Counsel for the petitioner submits that earlier prayer for bail of the petitioner was rejected by this Court vide order dated 07.03.2024 passed in Cr. Misc. No.82889 of 2023. Counsel submits that petitioner is in custody since 22.01.2023 having no criminal antecedent. Counsel submits that trial has not been concluded till date. Counsel further submits that status report was called for by this Court.

4. Learned Additional Public Prosecutor for the State opposes the prayer for bail and submits that total recovery of 66 Kgs of Ganja is subject matter of the present case which is commercial quantity.

5. From perusal of the report it transpires that out of five charge sheet witnesses three witnesses have been examined.

6. In the present facts and circumstances, this Court is not inclined to grant bail to the petitioner. Hence, the prayer for bail is refused.
