JUSTICE NAVANITI PRASAD SINGH ORAL ORDER 09-06-2015 The petitioner who is husband apprehends his arrest in relation to Complaint Case No. 355 of 2014 registered under Section 498A of the Indian Penal Code.
From the complaint itself, it is clear that this was the complainant's second marriage. She had earlier married and had three children. She now complains that after this marriage, she is being tortured. On behalf of the petitioner, it is submitted that the lady is an old lady and she always insists upon the petitioner to live separately, which has not been agreed and it is only because of the fact that such a case has been filed.
Be that as it may, in the event of his arrest/surrender before the court below within four weeks from
Patna High Court Cr.Misc. No.17912 of 2015 (2) dt.09-06-2015 2/2 today, let the petitioner, namely, Md. Imtiaz alias Imtiyaz alias Imtiyaz Ansari be enlarged on bail on furnishing bail bonds of Rs. 10,000/- (ten thousand only) with two sureties of the like amount each to the satisfaction of Sub Divisional Judicial Magistrate, Araria in connection with Complaint Case No. 355 of 2014, subject to condition laid down under Section 438(2) of the Code of Criminal Procedure.
