In this case the petitioner is seeking bail in Warisnagar P.S. Case No. 283 of 2014 registered under section 25(1-B)a/26/35 of Arms Act.

According to the first information report, on secret information the police reached to the place of occurrence where the police party found that certain criminals were preparing for committing crime. On chase the petitioner was apprehended from whose possession three used cartridges were recovered. The petitioner is in jail since 01.01.2015 and he has no criminal antecedent.

Considering the aforesaid facts, petitioner Md.

Patna High Court Cr.Misc. No.16993 of 2015 (2) dt.15-06-2015 2/2 Naseem is directed to be released on bail on his furnishing bail bond of Rs. 10,000/- (ten thousand) with two sureties of like amount each to the satisfaction of learned Judicial Magistrate, Ist Class, Samastipur in Warisnagar P.S. Case No. 283 of 2014 subject to the conditions (i) that one of the bailors will be a close relative of the petitioner who will give an affidavit giving genealogy as to how he is related with the petitioner. The bailor will undertake to furnish information to the court about any change in the address of the petitioner. (ii) That the affidavit shall clearly state that the petitioner is not accused in any other case and if he is , shall not be released on bail. (iii) The bailor shall also state on affidavit that he will inform the court concerned if the petitioner is implicated in any other case of similar nature after their release in the present case and thereafter the court below will be at liberty to initiate the proceeding for cancellation of bail on the ground of misuse.
