JUSTICE HEMANT KUMAR SRIVASTAVA ORAL ORDER 27-11-2019 Heard learned counsel for the petitioner as well as learned Additional Public Prosecutor for the State. Petitioner is in jail custody since 29.06.2019 in a case registered under sections 392 of the Indian Penal Code. Petitioner is not named in the first information report but in course of investigation, the name of petitioner surfaced in this case. However, petitioner was remanded in this case from another case and allegedly, made his confessional statement accepting his involvement in present case. Except the aforesaid material, there is nothing against the petitioner. However, up till now Investigating Officer did not take pain to put the petitioner on T.I.P.

Considering the aforesaid facts and circumstances as well as submissions of the parties, let the petitioner, above

No.55258 of 2019(3) dt.27-11-2019 2/2 named, be released on bail on furnishing bail bonds of Rs. 10,000/- (Ten Thousand) with two sureties of the like amount each to the satisfaction of Chief Judicial Magistrate, Katihar in connection with Falka P.S.Case No. 87 of 2019.
