JUSTICE ASHWANI KUMAR SINGH ORAL ORDER 27-01-2016 In the present application preferred under Articles 226 and 227 of the Constitution of India, the prayer of the petitioner in para-1 is as under:- "1. That this Criminal Writ is being filed on behalf of the petitioner for issuance of direction/directions, order/orders commanding upon the concerned respondents for the following relief or reliefs :- I) For that direction may be given to the

Patna High Court Cr. WJC No.388 of 2015 (2) dt.27-01-2016 2/3 concerned respondents for protection in cutting the wheat crops of the petitioner upon the land vide Khata No.12, Khesra No.3 Rakwa 17 bigha 8 katha 6 dhurs Jamabandi No.115 under the Mouza Itahri within Anchal Gogri under the district Khagaria.

II) For that the respondent No.9 may be directed not to cast hindrance in cutting the wheat crops by the petitioner upon the land till the further order passed by any concerned Court vide Khata No.12, Khesra No.3, Rakwa 17 bigha 8 katha 6 dhurs Jamabandi No.115 under the Mouza Itahri within Anchal Gogri under the district Khagaria.

III) For that during the pendency of the writ application interim order may be passed with regard to protection/security to the petitioner in course of cutting the wheat crops.

IV) For that any other relief or reliefs may also be provided to the petitioner if he deserves the same."

In view of the availability of an equally efficacious

Patna High Court Cr. WJC No.388 of 2015 (2) dt.27-01-2016 3/3 statutory remedy to the petitioner, I am not inclined to entertain the writ petition.

Accordingly, the application is dismissed.
