====================================================== CORAM: HONOURABLE MR. JUSTICE RAJENDRA KUMAR MISHRA ORAL ORDER 11-12-2019 Heard learned counsel for the petitioner, the learned counsel for the informant and learned Additional Public Prosecutor for the state.
The petitioner seeks pre-arrest bail in connection with Danapur P.S. Case No. 422 of 2019 (G.R. No. 1887 of 2019), registered under Sections 341, 323, 379, 498A, 504 and 506 of the Indian Penal Code and 3 and 4 of the Dowry Prohibition Act.
The accusation is of torturing of the informant by her husband and in-laws through various mode and removed her from matrimonial house snatching her personal belongings. Learned counsel appearing on behalf of the petitioner submits that on the joint prayer of the learned counsel for the
Patna High Court CR. MISC. No.54733 of 2019(4) dt.11-12-2019 2/2 petitioner and opposite party no. 2 the matter was referred to the Patna High Court Mediation Center for mediation, while the petitioner showed his desire to keep his wife-opposite party no. 2 with full dignity, but, she was not ready to go to the house of the petitioner.
Having regard to the facts and circumstances of the case, let the petitioner, above named, in the event of surrender/arrest, within a period of four weeks from today, in connection with Danapur P.S. Case No. 422 of 2019 (G.R. No. 1887 of 2019) shall be released on bail on furnishing bail bond of Rs.10,000/- (rupees ten thousand) with two sureties of the like amount each to the satisfaction of the Additional Chief Judicial Magistrate, I, Danapur, Patna, or the successor Court subject to the conditions as laid down under Section 438(2) Criminal Procedure Code.
