2. The petitioner seeks regular bail in connection with Nagar Ara P.S. Case No.554 of 2021, S.Tr. No.637 of 2023, lodged under Section 395 of the I.P.C. read with section 27 of the Arms Act.

3. Learned counsel for the petitioner submits that the bail application of the petitioner has earlier been rejected vide order dated 05.09.2022 passed in Cr. Misc. No.22326 of 2022 with specific direction to the Trial Court to release the petitioner after framing of charge.

4. Learned counsel for the petitioner further submits that the petitioner is in custody since 06.09.2021. He further submits that report of stage of the trial has been called for and

5. Learned counsel for the State opposes the prayer for bail.

6. In the present facts and circumstances of this case and the submissions made above, it transpires to this Court that the present case is pre-mature. Therefore, this Court is not inclined to grant bail to the petitioner at present. Therefore, the bail application of the petitioner is hereby rejected.

7. However, it is hereby directed to the Trial Court to submit a report that under what circumstances, charge has not been framed in this case. The said report shall be submitted to this Court within 4 weeks.
