JUSTICE HEMANT KUMAR SRIVASTAVA ORAL ORDER 21-06-2016 Heard learned counsel for the petitioner as well as learned Additional Public Prosecutor for the State. Petitioner happens to be father in law of the deceased and is being prosecuted for the offences punishable under Sections 304B/34 of the Indian Penal Code.
The deceased died within seven years of her marriage in other than normal circumstances and there is allegation that prior to her death she was subjected to cruelty and torture due to non fulfilment of dowry demand. The post mortem report of the deceased reveals that injuries were found on her person.
Therefore, considering the aforesaid facts and circumstances as well as submissions of the parties, I am not inclined to release the petitioner on bail, at least, at this stage and
Patna High Court Cr.Misc. No.24970 of 2016 (3) dt.21-06-2016 2/2 hence, his prayer for bail in connection with Kanti P.S. Case No. 68 of 2016 pending in the court of Sub Divisional Judicial Magistrate, (West) Muzaffarpur stands rejected. (Hemant Kumar Srivastava, J) SHAHZAD/- U T
