JUSTICE AKHILESH CHANDRA ORAL ORDER 14-01-2015 Heard learned counsel for the petitioners and learned Additional Public Prosecutor for the State.

All the petitioners apprehend their arrest in connection with a case registered for the offences punishable under Section 341, 323, 324, 379, 427 and 504/34 of the Indian Penal Code are named accused in this case and whose prayer was refused vide order dated 02.07.2013 by the learned Sessions Judge, Samastipur in ABP No. 244 of 2012. But playing with law for substantial long period, this application has been filed only on 21st July 2014, this itself disentitles the petitioners for the privilege sought.

Hence, their prayer for anticipatory bail, in connection with Tajpur Pusa P.S. Case No.463 of 2011 (GR. No. 2788 of 2011), pending before the Chief Judicial Magistrate, Samastipur is hereby refused with a direction to the petitioners to surrender before the Court below within three weeks from today and seek regular bail where their prayer for regular bail shall be considered and disposed of on its own merit, in accordance with law.
