JUSTICE SUNIL KUMAR PANWAR ORAL ORDER 07-02-2023 Heard learned counsel for the petitioners, learned counsel for the informant and learned APP for the State. The petitioners seek regular bail in connection with Sasaram (Town) P.S. Case No. 443 of 2022 registered for the offence under Sections 328, 302/34 of the Indian Penal Code. Allegation against the petitioners is of committing murder of the informant's daughter after administering her poison.
Learned counsel for the petitioners submits that the petitioners are innocent and have committed no offence.
Patna High Court CR. MISC. No.58993 of 2022(2) dt.07-02-2023 2/3 Petitioner no.1 is devar and petitioner no.2 is Gotini of the deceased due to which they have falsely been implicated in this present case. These petitioners have no concern mess and business of the deceased as well as her husband and they were living separately from them. It is further submitted vide para 13 of the petition that the informant lodged the present FIR against the husband of the deceased Deepak Singh as well as his family members thereafter, the informant also filed a complaint-cumprotest petition before concerned Court and the husband of the deceased has not been made an accused in a protest petition whereas nor any allegation leveled against him which clearly indicates that the informant lodged such a false case at the instance of victim's husband with a view to grab the share of the petitioners. A statement has been made in para-3 of the petition that the petitioner has got no criminal antecedent. It is further submitted that the petitioners are languishing in judicial custody since 2.8.2022.
Learned APP appearing for the state and learned counsel for the informant have vehemently opposed the prayer of regular bail.
Having heard learned counsel for the parties and considering the facts and circumstances of the case, this court is
Patna High Court CR. MISC. No.58993 of 2022(2) dt.07-02-2023 3/3 inclined to enlarge the petitioners on bail. The above named petitioners are directed to be released on bail in connection with Sasaram (Town) P.S. Case No. 443 of 2022 on furnishing bail bond of Rs.10,000/- (ten thousand) each with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Rohtas at Sasaram.
