2. The petitioner seeks bail in a case registered for the offence punishable under Section 392 of the Indian Penal Code.

3. As per prosecution case, on the alleged date and time of occurrence, four unknown miscreants, on the point of pistol, intercepted the informant and his nephew and snatched bag of informant containing cash of Rs. 1,75,000/-, mobile phone and other important document(s).

4. It is submitted by learned counsel for the petitioner that petitioner is not named in the F.I.R. and has committed no offence. Name of petitioner has transpired in this during course of investigation. No stolen article has been recovered from the conscious possession of this petitioner and

Patna High Court CR. MISC. No.62548 of 2024(2) dt.06-12-2024 2/2 till date, petitioner has not been sent up for T.I. parade. Petitioner is in custody since 29.05.2024. Moreover, chargesheet has already been submitted.

5. Learned A.P.P. for the State has vehemently opposed the prayer for grant of bail to the petitioner.

6. Considering the aforesaid facts and circumstances of the case, rival submissions, nature of accusation, the fact that no incriminating article has been recovered from possession of this petitioner and period of custody, the prayer for grant bail of to the petitioner is allowed.

7. Accordingly, let the above named petitioner be released on bail on furnishing bail-bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned A.C.J.M. 2nd, West, Muzaffarpur, in connection with Motipur P.S.
