Petitioner apprehends arrest in connection with Gopalpur P.S. Case No. 64 2021 registered for the offence punishable under sections 341, 323, 353, 427, 504, 506/34 of the Indian Penal Code and Section 30(a) of the Bihar Prohibition and Excise Act.

Learned counsel appearing for the petitioner submits that petitioner has been falsely implicated in this case. Nothing has been recovered from the conscious possession of this petitioner. The vehicle from which the alleged recovery has been made does not belong to this petitioner. Petitioner has no concern with the seized article.

Considering the facts and circumstances of the case

Patna High Court CR. MISC. No.69937 of 2021(7) dt.05-05-2023 2/2 and the submissions advanced on behalf of the parties, let the petitioner, above named, be released on bail on furnishing bail bonds of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of Additional Sessions Judge II, Gopalganj in connection with Gopalpur P.S. Case No. 64 of 2021 subject to the conditions laid down under section 438(2) of the Code of Criminal Procedure.
