JUSTICE AJAY KUMAR TRIPATHI ORAL JUDGMENT Date: 05-05-2016 Writ is required to be dismissed because the maximum pension which could be made available under the Employees Provident Fund has been sanctioned and is being paid. The husband of the petitioner was not a government servant but an employee of the Corporation where contributory provident fund was in vogue. There is a set formula statutory in nature based on which the calculation for minimum pension is worked out under the Employees Provident Fund and prayer of the petitioner that a calculation chart should be provided to her may not be acceded to
Patna High Court CWJC No.12747 of 2014 dt.05-05-2016 2/2 because that calculation can be done by any layman by looking at the formula based on which such calculation is done. If the petitioner is not satisfied, let her invoke the powers under Right to Information Act instead of wasting judicial time on such litigation. Writ is dismissed.
