JUSTICE RAKESH KUMAR ORAL ORDER 17-09-2015 On call, none appeared on behalf of the petitioner either to press this petition or to make a prayer for adjournment. Learned AC to Principal Addl. Advocate General submits that in the present writ petition, the petitioner has prayed for grant of benefit under the ACP Scheme with all consequential benefits, whereas the petitioner is facing criminal trial on accusation of misappropriation of government fund. Besides this, in the departmental proceeding, the petitioner has been inflicted major punishment. According to learned State Counsel, the benefit under the ACP Scheme is not granted to those employees, who are facing criminal prosecution or against whom a departmental proceeding is pending.

Be that as it may, since none appeared on behalf of the petitioner, the writ petition stands dismissed due to nonprosecution. NKS/- (Rakesh Kumar, J) U
