The petitioner seeks anticipatory bail in a case instituted for the offences under Sections 406 and 420/34 of the Indian Penal Code.

Petitioner was Khalashi of a truck bearing registration no.WB-23C 5226 and it was loaded with wheat. He handed over the key of the track to the informant and requested him to hand over the key to the owner of the truck. Allegation has been made that he has gone with the truck but the fact is that he resides there and he did not go with the truck. There is no entrustment to the petitioner rather allegation has been made against the owner of the truck.

Patna High Court Cr.Misc. No.18031 of 2015 (3) dt.09-07-2015 Looking to the facts and circumstances of the case, in the event of arrest or surrender within four weeks from today, let petitioner, namely, Ranjit Rai, be released on anticipatory bail on furnishing bail bonds of Rs.10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of the Judicial Magistrate, Saran at Chapra in connection with Bheldi P.S. Case No.113 of 2014, subject to the conditions as laid down under Section 438(2) of the Code of Criminal procedure.
