ANJANA MISHRA ORAL ORDER 16-08-2016 Heard learned counsel for the petitioner and the learned counsel appearing on behalf of the State. The petitioner is apprehending his arrest in connection with Buxar Town P.S. Case No.254 of 1995 registered for the offence under Section 302/34 of the Indian Penal Code and Section 27 of the Arms Act.

Case diary in the present case was called for, which has since been received.

After hearing learned counsel for the petitioner and the learned counsel for the State and on perusal of the case diary, it appears that the name of the petitioner was introduced only on suspicion, even though it has come on record that the petitioner and one Sanjay Kumar were good friends with the

Patna High Court Cr.Misc. No.24589 of 2016 (3) dt.16-08-2016 2/2 deceased and there was no dispute whatsoever at any point of time. In fact, it was to the contrary.

In view of such facts and circumstances and there being no cogent material in the case diary, let the petitioner, above named, in the event of his arrest or surrender before the court below within a period of four weeks from the date of receipt/production of a copy of this order, be released on bail on furnishing bail bond of `10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of the learned Chief Judicial Magistrate, Buxar, in connection with Buxar Town P.S. Case No.254 of 1995, subject to the conditions as laid down under Section 438(2) of the Code of Criminal Procedure.
