The petitioner is languishing in custody for the offence punishable under Section 30(a) of the Bihar Prohibition and Excise Act, 2018.

Foreign liquor was allegedly recovered and prosecution report has been submitted without proper investigation of the case. The petitioner is in custody since 19.07.2019. The petitioner has stated on oath that he has got no criminal antecedent.

Considering the aforesaid fact, let the petitioner, above named, be released on bail after framing of the charge on furnishing bail bond of Rs.20,000/- (Twenty Thousand) with

Patna High Court CR. MISC. No.55750 of 2019(2) dt.05-09-2019 2/2 two sureties of the like amount each to the satisfaction of the learned Court-below where the case is pending in connection with Excise Case No.128 of 2019, with following conditions: (a) Both the bailors shall be the resident of territorial jurisdiction of the learned Court-below.
