The petitioner by invoking the extraordinary writ jurisdiction of this Court under Article 226 of the Constitution, has preferred the instant writ petition seeking a direction upon the respondents for restoration of the lands to physical possession of the petitioner falling within Mauza Majhaulia, P.S.-Sakra, District-Muzaffarpur, which has been illegally encroached/taken into physical possession by the private respondents despite the Title Suit no. 432 of 2011 filed by the private respondents got dismissed for default due to nonprosecution on 05.11.2018.

3. From the averments made in the writ petition as well as the relief(s) sought for, prima facie, it appears to be a private dispute and for which a writ of mandamus cannot be applicable. Suffice it to say that a writ of mandamus can be issued only when any public authority exercises its duty unlawfully and refuses to exercise its duty which has been statutorily assigned upon them.

4. However, after some arguments, learned counsel for the petitioner seeks permission to approach before respondent no.2, the Collector, Muzaffarpur, for redressal of his

5. In view thereof, the present writ petition stands disposed off with the liberty aforesaid.
