ANJANA MISHRA ORAL ORDER 19-09-2016 Heard learned counsel for the petitioner and learned counsel appearing on behalf of the State.
The petitioner apprehends his arrest in connection with Ara SC/ST P.S. Case No. 32 of 2016 for the offences registered under Sections 323, 324, 341, 354B & 506/34 of the Indian Penal Code and Section 3 (1) (x) (xi) of the Scheduled Castes and Scheduled Tribes (Prevention of Atrocities) Act, 1989 Act. Learned counsel for the petitioner submits that provisions of Section 3 (1) (x) of the Scheduled Castes and Scheduled Tribes (Prevention of Atrocities) Act, 1989 Act have been levelled against the petitioner only to make the charge graver. Admittedly, the occurrence is said to have taken at the door-step of the present petitioner. Moreover, the main allegation of assault is against one Krishna Kumar, who has since been extended the privilege of anticipatory bail. The other two accused
Patna High Court Cr.Misc. No.30523 of 2016 (3) dt.19-09-2016 persons have also been extended the privilege of anticipatory bail vide order dated 02.05.2016 passed in Cr. Misc. No. 18232 of 2016.
Considering the aforesaid facts and circumstances of the case and that similarly situated co-accused persons have been extended the privilege of anticipatory bail, let the petitioner, above named, in the event of his arrest or surrender before the court below within a period of four weeks from the date of receipt/production of a copy of this order, be released on bail on furnishing bail bonds of Rs.10,000/- (Ten thousand) each with two sureties of the like amount each to the satisfaction of A.C.J.M., V, Bhojpur at ARa in connection with Ara SC/ST P.S. Case No. 32 of 2016, subject to the conditions as laid down under Section 438(2) of the Code of Criminal Procedure.
