JUSTICE CHANDRA SHEKHAR JHA ORAL ORDER 20-11-2025 Heard learned counsel appearing on behalf of the petitioner, learned A.P.P. for the State and learned counsel for the informant.
2. The accused/petitioner seeks bail in connection with Jakkanpur P.S. Case No. 513 of 2024 registered for the offences under Sections 352 ad 64 of the Bhartiya Nyay Sanhita, 2023 (in short, the 'B.N.S.') and section 4 & 6 of the POCSO Act, pending in the court of learned Additional Sessions Judge-VI-cum-Special Judge, POCSO, Patna corresponding to Special (POCSO) Case No. 249 of 2024.
3. Considering the submission as the trial of this case is at its fag end and only the Investigating Officer of this case is
Patna High Court CR. MISC. No.58927 of 2025(3) dt.20-11-2025 2/2 required to be examined, accordingly, prayer of bail of the petitioner is rejected for the present.
4. However, as the petitioner being 70 years and remained in custody since 12.09.2024, against whom cognizance was taken by the learned Special Court on 22.01.2025, therefore, learned trial court is directed to conclude the trial in all aspect within the timeline as provisioned under section 35(2) of the POCSO Act, failing which petitioner be at liberty to renew his prayer for bail, if so advised.
5. Learned Special Court is also directed to take appropriate steps to examine the Investigating Officer of this case within 30 days on receipt/production of a copy of this order.
6. Let a copy of this order be sent to Senior Superintendent of Police, Patna to ensure examination of Investigating Officer of this case positively on the next date fixed by the learned Special Court.
7. Accordingly, this application stands disposed of with aforesaid direction.
