The petitioners apprehend their arrest in Nawada Town P.S. case No. 724 of 2018 registered under Section 307 and other minor Sections of the Indian Penal Code. The informant named all the petitioners and alleged that they came to her house and Sonelal Chauhan, petitioner No.1, assaulted her with Tangi on her head. She got bleeding injury. When Shyam Sunder Chauhan came to save, Pintu Chauhan, petitioner No.3, assaulted him with chopper. Bipin Chauhan, petitioner No.2, assaulted him with iron rod on his right hand. Petitioner No.4 and 5 assaulted the mother of informant with iron rod.
The learned counsel for the petitioners submits that
Patna High Court Cr.Misc. No.2156 of 2019(2) dt.16-01-2019 2/2 there is counter version being Nawada Town P.S. case No. 723 of 2018. Petitioner No.5 is informant of the case. The informant, Rubi Devi and Gauri Devi got simple injuries. Shyam Sunder also got simple injuries as submitted by learned counsel for the petitioners.
Taking into consideration that there is case and counter case and there appears that both sides entered into mutual scuffle in which the injured got simple injuries, the petitioners, above named, in the event of their arrest or surrender before the learned court below within a period of four weeks from the date of receipt/ production of a copy of this order are directed to be enlarged on bail on furnishing bail bond of Rs. 10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of the learned Chief Judicial Magistrate, Nawada in connection with Nawada Town P.S. Case No. 724 of 2018, subject to conditions as laid down under Section 438(2) of the Code of Criminal Procedure. (Prabhat Kumar Jha, J) BKS/- U T
