JUSTICE PRABHAT KUMAR SINGH ORAL ORDER 22-12-2022 After some arguments learned counsel for the petitioners seeks permission to withdraw this anticipatory bail petition so far as petitioner no.2 is concerned. Permission is granted.

The anticipatory bail petition is dismissed as withdrawn.

Heard learned counsel for the petitioner no.1 and the State.

Petitioner no. 1 apprehends arrest in a case registered for the offence punishable under Sections 341, 323, 494,

Patna High Court CR. MISC. No.59736 of 2022(2) dt.22-12-2022 2/2 498(A), 307, 379/34 of the IPC and section 3⁄4 of the Dowry Prohibition Act.

As per the prosecution case, allegation of torture and harassment is against petitioner no.1 due to non-fulfillment of demand of dowry.

Petitioner no. 1 is father in law and he is separate in mess and property.

Considering the facts of the case, in the event of arrest/surrender within six weeks from today, let the petitioner no.1, above named, be released on bail on furnishing bail bond of Rs.10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned Sub-Divisional Judicial Magistrate, Bettiah, West Champaran in connection with Bagaha Mahila P.S. FIR No. 49 of 2022 subject to the conditions laid down under section 438(2) of the Code of Criminal Procedure.
