The petitioner seeks bail in Harsidhi P.S. Case no. 376/2014, registered for the offences punishable under Sections 307, 353 and other Sections of the Indian Penal Code and 3⁄4 of Explosive Substance Act.

The police on confidential information went to raid and alleged that when police personnel were chasing the criminals one bomb was exploded by the criminals. On chase, the petitioner and two other persons were apprehended. The police also recovered one country made bomb from the bush and it is alleged that the petitioner has thrown the bomb in the bush. Nothing has been recovered from the conscious possession of the petitioner.

Patna High Court Cr.Misc. No.19206 of 2015 (3) dt.24-06-2015 From perusal of the contents of the FIR, it appears that the informant did not identify the person who had thrown the bomb.

Considering the facts aforesaid and the fact that the petitioner is in jail since 30.11.2014, the petitioner above named is directed to be enlarged on bail on furnishing bail bond of Rs. 10,000/- (Ten Thousand) with two sureties of the like amount each to the satisfaction of the learned Chief Judicial Magistrate, Motihari, East Champaran, in connection with Harsidhi P.S. Case no. 376 of 2014.
