====================================================== CORAM: HONOURABLE MR. JUSTICE SATYAVRAT VERMA ORAL ORDER 05-05-2022 Heard learned counsel for the petitioners and learned A.P.P. for the State.
Let the defect(s), if any, be removed within a period of four weeks after complete start of the physical Court. The petitioners seek bail in a case registered for the offences punishable under Sections 366(a)/34 of the Indian Penal Code.
Learned counsel for the petitioners submits that the petitioners are in custody since 28.09.2021, are persons with clean antecedent and charge-sheet has been submitted in this case. The informant alleges that his minor daughter was missing since 22.09.2021. When the search was made the informant came to know that four accused persons after enticing her took away either for marriage or for establishing illicit intercourse.
Patna High Court CR. MISC. No.70421 of 2021(2) dt.05-05-2022 2/2 Learned counsel for the petitioners submits that the petitioners have been falsely implicated in the present case. The victim has returned and in her statement under Section 164 Cr.P.C. she has not named the petitioners nor alleges that any wrong was committed with her.
Learned A.P.P. for the State vehemently opposes the prayer for regular bail of the petitioners.
Considering the fact that the petitioners are in custody since 28.09.2021, are persons with clean antecedent, charge-sheet has been submitted and the victim has not taken the name of the petitioners in her statement under Section 164 Cr.P.C. as submitted by the learned counsel for the petitioners, the petitioners, above named, are directed to be released on bail on furnishing bail bonds of Rs.10,000/- (Rupees Ten Thousand) each with two sureties of the like amount each to the satisfaction of the learned Court below where the case is pending in connection with Bhabhua (Sonhan) P.S. Case No. 509 of 2021.
