2. The arms appeal of the petitioner vide Arms Appeal No. 78 of 2006 has been dismissed on 17.06.2006 on the ground of limitation.
3. I am of the view that the aforesaid Arms Appeal should have been heard because the delay in filing the same was caused due to the illness of the appellant's wife.
4. In these circumstances, the limitation in filing the Arms Appeal is hereby condoned and the order dated 17.06.2006 is set aside.

5. The matter is remitted back to the Commissioner, Patna for consideration of the Arms Appeal within three months from the date of receipt/production of a copy of this order.
