====================================================== CORAM: HONOURABLE MR. JUSTICE SANJAY PRIYA ORAL ORDER 16-01-2019 Heard learned counsel for the petitioner and the State.

The petitioner seeks bail in Nayagaon P.S. Case No. 47 of 2018 (Sessions Trial No. 672 of 2018), instituted for the offence under Sections 302, 201 and 34 of the Indian Penal Code.

As per written report the informant who is Chowkidar got information that two dead bodies are lying at Dumari Chitupakar near Ganga river Ghat. The informant reached there and found two unknown bodies and one Motorcycle lying there. He informed the concerned SHO. Thereafter, the police arrived there. The villagers assembled there identified one dead body as Sawan Mahto, but second dead body could not be identified by them. The Chowkidar

Patna High Court Cr.Misc. No.2149 of 2019(2) dt.16-01-2019 2/2 Ramlal Manjhi identified Sawan Mahto as active criminal. He identified the second dead body as Abhimanyu Kumar. They both were friends.

Counsel for the petitioner submits that petitioner is not named in the written report. The police has arrested the petitioner merely on suspicion and recorded his confessional statement which finds mention in paragraph-37 of the case diary.

Petitioner is in custody since 14.6.2018.

Considering the aforesaid facts and circumstances of the case, prayer for bail of the petitioner is allowed. Let the petitioner above named, be released on bail on furnishing bail bond of Rs.10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of learned Additional Sessions Judge-10th, Saran at Chapra, in connection with Nayagaon P.S. Case No. 47 of 2018 (Sessions Trial No. 672 of 2018), subject to the condition that both the bailors will be the close relatives of the petitioner.
