The matter has been listed under the heading "For Orders" under the orders of Hon'ble the Chief Justice. Heard learned counsel for the petitioner and learned APP for the State.

Allegedly, the deceased was on business term and in consequence thereof, he gave loan of Rs. 1,00,000/- to one of the accused. It is further alleged that when the deceased went to demand his money back, the accused persons assaulted him by Lathi, Danda and brick, as a result of which, the deceased namely Shahbaz received injury and died.

Earlier, the petitioner was granted provisional anticipatory bail by order dated 03-09-2019.

It has been submitted on behalf of the petitioner that the

Patna High Court CR. MISC. No.55946 of 2019(3) dt.12-06-2020 2/2 petitioner has got no criminal antecedent. There is no allegation of tampering of witnesses alleged against the petitioner. General and omnibus allegation has been made against the petitioner. No specific overt act is alleged against the petitioner. No specific injury is attributed to the petitioner.

On behalf of the State, it is submitted that the petitioner is named in the Complaint Case/F.I.R.

Considering the aforesaid facts and circumstances of the case, the provisional anticipatory bail granted to the petitioner by order dated 03-09-2019 is, hereby, confirmed. (Sudhir Singh, J) A.K.V.//- U T
