The petitioner seeks bail in a case registered for the offences punishable under Section 395 of the Indian Penal Code.
The learned counsel for the petitioner submits that the petitioner is in custody since 19.03.2021, he is a person with a clean antecedent and charges have been framed. Allegation is of looting the bank of Rs.14,42,170/- by six unknown criminals. Further the criminals even looted some customers also.
The learned counsel for the petitioner submits that the petitioner has been falsely implicated in the present case and his name came in the confessional statement of co-accused Bijli
Patna High Court CR. MISC. No.70329 of 2021(2) dt.18-04-2022 2/2 Paswan. It is further submitted that during the course of investigation, it is alleged that Rs.3,000/- was recovered from the house of the petitioner. It is further submitted that there is absolutely no investigation to connect the recovered amount as that of the looted money of the bank i.e. Gramin Bank. The learned counsel further submits that petitioner was not put on T. I. Parade and is a person with clean antecedent. Learned A.P.P. opposes the bail application.
Considering the fact that the petitioner is in custody, he is a person with a clean antecedent and charges have been framed, the petitioner, above-named, is directed to be released on bail on his furnishing bail-bonds in the sum of Rs. 25,000/- (Rupees Twenty Five Thousand) with two sureties of the like amount each to the satisfaction of learned Court below where the case is pending in connection with Nardiganj P. S. Case No.40 of 2021.
The application stands allowed.
